Terms & conditions of Entry for the "Telstra People's Choice" Promotion ("Promotion")
- Information on how to enter and the prizes form part of the conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
- The Promoter is Telstra Corporation Limited (ABN 33 051 775 556) of 2/400 George Street, Sydney, NSW 2000 (“Promoter”).
- Entry is open to Australian residents (“Eligible Entrants”). Management and employees (and their immediate families) of the Promoter, The Australian Ballet and the agencies and other companies associated with this Promotion are not eligible to enter.
- The Promotion starts at 9:00am AEDT on 7 March 2008 and ends at 11:59 pm AEDT on 14 November 2008 (“Promotion Period”).
- To enter and be eligible to win, Eligible Entrants must:
- visit Be Involved and fully complete an online entry form with correct contact details as prompted, and a nomination for their favourite Australian Ballet dancer from the selection of nominees; or
- send a text message to 0439 BALLET (0439 225 538) with the first name of their favourite Australian Ballet dancer from the selection of nominees.
- Eligible Entrants may enter as many times as they wish.
- The person whose mobile service is used to send the text message will be deemed the entrant. Normal carriers' premium text message costs apply to enter. In any event, the cost of entry will not exceed 55 cents (including GST).
- At 12 midday AEDT on 17 November 2008, a random computerised prize draw from all eligible entries received will be conducted at 70 Mullens Street, Balmain NSW 2041 ("Draw Location").
- The Eligible Entrant with the first eligible entry drawn will win:
- four Premium reserve tickets to The Australian Ballet's performance of Manon at the Sydney Opera House on a date to be confirmed between 28 November – 17 December 2008, valued at $400;
- a pre-performance dinner for the themselves and their three guests valued at up to $1,000;
- one night's accommodation (twin-share) in a four star hotel for four people in Sydney valued at up to $600; and
- if the winner lives outside of NSW, four adult return economy class flights to Sydney departing from the winner's nearest Australian capital city valued at up to $3,000.
(together the "Prize" valued at up to $5,000)
- If the winner is a Telstra customer (for any Telstra fixed, mobile or internet service) at the time of entry and prize draw, they will also receive a Bonus Prize (“Bonus Prize”) of $5,000 (payable by cheque).
- All other ancillary costs associated with the taking and use of the Prize (including but not limited to, all transfers, meal expenses not stated as included and travel insurance) are the responsibility of the winner. Terms of use also apply to The Australian Ballet performance tickets.
- If the winner is under the age of 18 years, they must be accompanied by their parent or legal guardian when taking the Prize. The winner's guest must be over 18, or if under 18, the guest's parent or legal guardian must give consent (in a form acceptable to the Promoter) to accompany the winner in taking the Prize. It is a condition of taking the Prize that the winner and their guests take out appropriate travel insurance. If the winner or a guest elects not to take any element of the Prize, the Promoter is not obliged to provide an alternate prize. The winner must be able to travel to Sydney for the performance.
- Maximum total prize value is $10,000 (including GST).
- The winner will be notified by telephone and in writing (and by return text message if the winning entry was sent by text message) by 19 November 2008. The results will be published in The Australian on 22 November 2008 and at Be Involved.
- If the original winner of the Prize is a resident of any State or Territory other than SA, the Promoter may conduct a further draw at the Draw Location at 9:00am (AEDT) on 1 December 2008 in order to distribute the Prize if it remains unclaimed by that date subject to any written direction of State or Territory lottery authority. The Bonus Prize will only be awarded if the winner is a Telstra customer at the time of entry and the unclaimed prize draw. The winner will be notified by phone within two days of the unclaimed prize draw and in writing. Any unclaimed prize winner under this term will be published in The Australian on 5 December 2008.
- If the original winner of the Prize is a resident of SA, the Promoter may conduct a further draw at 9:00am (AEDT) at the Draw Location on 26 February 2009 in order to distribute the Prize if it remains unclaimed by that date, subject to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). The draw will be for the equivalent cash amount of the Prize. The Bonus Prize will only be awarded if the winner is a Telstra customer at the time of entry and the unclaimed prize draw. The winner will be notified by phone within two days of the unclaimed prize draw and in writing. Any unclaimed prize winner under this term will be published in The Australian on 19 February 2009.
- Incomplete and incomprehensible entries and entries with defamatory or offensive content or incorrect contact details are not eligible to win. The Promoter accepts no responsibility for misdirected, lost or delayed entries and entries not received for any reason during the Promotion Period, nor for any technical difficulties with the entry mechanisms.
- Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process, will be ineligible to win.
- The Prize is not transferable, divisible or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in the value or content of the Prize. If the Promoter is unable to provide the winner with any element of the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value, subject to State and Territory legislation.
- The judge's decision is final and binding and no correspondence will be entered into.
- The Promoter will not be held liable for any loss, damage or injury which results directly or indirectly from this Promotion, except that which cannot be excluded by law.
- By accepting the prize, the winner agrees to be contacted by the Promoter about the Promotion and participate in the Promoter's publicity activities as reasonably requested, including being photographed by the Promoter for use by the Promoter in future marketing and promotional activities without requiring further payment by the Promoter or further consent from the winner.
- All entries become the property of the Promoter. By entering this Promotion entrants understand and agree that the Promoter may use and disclose the information provided by them on the terms and for the purposes (including marketing) set out in Telstra's Privacy Statement or by calling 1800 039 059.
